These Terms constitute a legally binding agreement between you and PowerLaunch regarding your use of our website and hosting services.

2. Description of Services

PowerLaunch provides managed WordPress hosting services, including but not limited to:

• WordPress website hosting and management
• Automatic backups and restoration services
• SSL certificate provisioning and management
• Content Delivery Network (CDN) integration
• Staging environment creation and deployment
• Security monitoring and malware protection
• 24/7 technical support
• Performance optimization and caching

3. Account Registration

To use our services, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

You must be at least 18 years old to create an account and use our services.

4. Acceptable Use Policy

You agree not to use our services to:

• Host, store, or transmit illegal content
• Distribute malware, viruses, or harmful code
• Engage in phishing, fraud, or deceptive practices
• Send unsolicited bulk email (spam)
• Infringe on intellectual property rights
• Host adult content without proper age verification
• Engage in cryptocurrency mining
• Attack or compromise other systems or networks
• Violate any applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate this policy without prior notice.

5. Payment Terms

5.1 Billing

Our services are billed on a subscription basis. You agree to pay all fees associated with your selected plan. Prices are subject to change with 30 days notice.

5.2 Refunds

We offer a 30-day money-back guarantee for new customers. After the initial 30 days, refunds are provided at our discretion. Refunds do not apply to:

• Domain registration fees
• Add-on services
• Accounts terminated for policy violations

5.3 Cancellation

You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of your current billing period.

6. Service Level Agreement

PowerLaunch commits to a 99.99% uptime guarantee for our hosting infrastructure. If we fail to meet this commitment, you may be eligible for service credits as follows:

• 99.9% - 99.99% uptime: 10% service credit
• 99.0% - 99.9% uptime: 25% service credit
• Below 99.0% uptime: 50% service credit

Scheduled maintenance and issues outside our control (DDoS attacks, natural disasters, etc.) are excluded from uptime calculations.

7. Data and Backups

We perform daily automated backups of your WordPress site with 30-day retention. While we take reasonable precautions to protect your data, you are ultimately responsible for maintaining your own backups. PowerLaunch is not liable for data loss.

You retain all ownership rights to your content. We do not claim any intellectual property rights over your website content.

8. Intellectual Property

The PowerLaunch name, logo, and all related marks are trademarks of PowerLaunch. Our website content, design, and software are protected by copyright and other intellectual property laws.

You may not copy, modify, distribute, or reverse engineer any part of our services without prior written consent.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POWERLAUNCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claims arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless PowerLaunch, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, your content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account at any time for:

• Violation of these Terms or our Acceptable Use Policy
• Non-payment of fees
• Fraudulent activity
• At our sole discretion with 30 days notice

Upon termination, you will have 30 days to retrieve your data before it is permanently deleted.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through our website. Your continued use of our services after such changes constitutes acceptance of the modified Terms.
